1. Who we are and agreement to these Terms
These Terms of Service (“Terms”) govern your access to and use of the HandleAm platform, including the website at handleam.com, the booking and job-tracking pages, the technician application, the supplier portal, and any related services (together, the “Platform”). The Platform is operated by HandleAm Tech Limited, a company registered in Nigeria with RC number 9718125, with its registered office at 17 Supreme Mothers Street, Effurun, Delta State, Nigeria (“HandleAm”, “we”, “us”).
By booking a repair, creating an account, accepting a job, or otherwise using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.
2. Definitions
- “Customer” — a person or business that books generator repair or servicing through the Platform.
- “Technician” — an independent, vetted generator repair professional who accepts and performs jobs sourced through the Platform.
- “Supplier” — an independent, verified vendor of generator parts who fulfils part orders placed through the Platform.
- “Job” — a repair, diagnosis, or servicing engagement booked by a Customer through the Platform.
- “Quoted Price” — the price presented to the Customer on the Platform before work proceeds, stated in Nigerian Naira (₦).
- “Tracking Link” — the unique tokenised link by which a Customer follows the progress of a Job without creating an account.
3. What HandleAm does (and does not do)
HandleAm operates a technology platform that connects Customers with independent Technicians and Suppliers, manages booking, dispatch, pricing presentation, job tracking, communications, and payment collection, and provides quality processes such as Technician vetting and dispute handling.
Technicians and Suppliers are independent contractors and independent businesses. They are not employees, partners, or joint venturers of HandleAm.
HandleAm vets Technicians (including identity checks and skills screening) and verifies Suppliers before admitting them to the Platform. Vetting reduces risk but is not a guarantee of any particular outcome.
4. Eligibility and service area
You must be at least 18 years old and capable of entering a binding contract to use the Platform. The service is currently available only within our published coverage areas in Warri, Delta State, Nigeria. Bookings outside the coverage area may be declined.
5. Booking, accounts and the Tracking Link
Customers may book without creating an account. On booking, we issue a Tracking Link unique to the Job. Anyone in possession of the Tracking Link can view the Job’s status and details, so Customers should not share it beyond people they trust with that information.
Technicians and Suppliers access the Platform through registered accounts and must keep their login credentials confidential. You are responsible for activity under your account. Information you provide at registration and during use must be accurate and kept up to date.
6. Pricing and payment
Prices are presented in Naira before work proceeds. A call-out/diagnosis fee may apply and will be disclosed at booking. If diagnosis reveals additional work or parts, an updated Quoted Price will be presented for the Customer’s approval before that work proceeds. Work done without a presented and accepted price is at the Technician’s risk.
Payment is collected on completion of the Job through our payment processor, Paystack. We do not store your card details; card and bank information is handled by Paystack under its own terms and security certifications. No cash payment fallback is permitted; all payments must be made electronically through the Platform.
7. Cancellations, rescheduling and refunds
Customers may cancel or reschedule free of charge before a Technician is dispatched. Once a Technician has been dispatched or has arrived, the call-out fee may still be payable. Where a Customer has paid for parts that have been procured specifically for the Job, cancellation after procurement may make those parts non-refundable, except where the part is defective or not as described.
Refunds, where due, are processed to the original payment method via Paystack within 10 business days of approval.
8. Repairs, parts and workmanship warranty
Technicians will perform Jobs with reasonable skill and care. Parts supplied through the Platform are sourced from verified Suppliers and are required to be genuine or of stated equivalent quality; the part’s description will be visible to the Customer before approval.
Workmanship on a completed Job is covered by a 30-day warranty from the completion date: if the same fault recurs within that period, we will arrange re-attendance at no additional labour charge. The warranty does not cover new or unrelated faults, damage caused by misuse, fuel or power quality issues, or intervention by third parties after the Job.
9. Terms specific to Technicians and Suppliers
Technicians and Suppliers contract with HandleAm on Platform participation terms and, for each Job or order, deal with the Customer as independent providers. They must: comply with applicable law; hold any required permits; perform work and supply parts to the standards published on the Platform; use only the Platform’s pricing and payment flows for Platform-sourced Jobs (off-platform diversion of Platform-sourced Customers is prohibited); and cooperate with dispute resolution.
Payouts to Technicians and Suppliers are made to their registered bank accounts, net of the Platform’s service fee of 0.5% plus ₦50 per Job, or as otherwise agreed, on the payout schedule published in the Platform. HandleAm may withhold or reverse payouts where a Job is disputed, fraudulent, or charged back, pending resolution.
10. Customer obligations
Customers must provide accurate information about the generator and its fault, ensure safe access to the equipment, disclose known hazards, and ensure an adult is present during the visit. Technicians may decline or pause work where conditions are unsafe, and the call-out fee remains payable in that case.
11. Disputes about a Job
If a Customer is dissatisfied with a Job or a part, they should raise it through the Platform or our published contact channels within 7 days of confirmation of the Job’s completion. We will review the Job record (including timestamps, photos, and communications), may arrange inspection or re-attendance, and will decide in good faith whether a re-do, refund, or other remedy is appropriate. Both Customers and Technicians agree to cooperate with this process before pursuing other remedies. This process does not limit any rights a consumer has under Nigerian law.
12. Liability
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Nigerian law, including under the Federal Competition and Consumer Protection Act 2018, or liability for death or personal injury caused by negligence, or for fraud.
Subject to the above: (a) HandleAm’s total aggregate liability to a Customer in connection with a Job is limited to ₦100,000 (one hundred thousand Naira), and will not exceed that amount under any circumstances; (b) HandleAm is not liable for indirect or consequential losses, including loss of business, revenue, or data, or losses arising from the generator being out of service; and (c) as the Platform operator on the marketplace model, HandleAm is not the performer of the repair, and responsibility for the workmanship of a Job rests with the Technician, without prejudice to the warranty and dispute processes above.
13. Indemnity
Technicians and Suppliers will indemnify HandleAm against claims and losses arising from their breach of these Terms, their negligence, or their violation of law in performing Jobs or supplying parts.
14. Intellectual property and Platform use
The Platform, its software, branding, and content are owned by or licensed to HandleAm. You may not copy, scrape, reverse engineer, interfere with, or misuse the Platform, attempt to access other users’ data, or use the Platform for unlawful purposes. Job photos uploaded to the Platform may be used by HandleAm for operating the service, quality assurance, and dispute resolution, as described in the Privacy Policy.
15. Suspension and termination
We may suspend or remove any user from the Platform for breach of these Terms, fraud, abusive conduct toward other users, safety concerns, or legal requirement. Technicians and Suppliers may leave the Platform by notice, subject to completing accepted Jobs and settling outstanding amounts.
16. Communications
By using the Platform you consent to receive service communications about your Jobs and account by SMS, WhatsApp, push notification, email, and phone call. Service communications are necessary to operate the Platform and cannot be opted out of while a Job is active. Marketing communications, if any, will only be sent with consent and will include an opt-out.
17. Privacy
Our collection and use of personal data is described in the HandleAm Privacy Policy, which forms part of these Terms.
18. Changes to these Terms
We may update these Terms from time to time. Material changes will be notified through the Platform or by the contact details you have provided, with the effective date stated. Continued use after the effective date constitutes acceptance. The version in force at the time a Job is booked governs that Job.
19. Governing law and disputes with HandleAm
This Agreement shall be governed, construed, and enforced pursuant to the laws of the Federal Republic of Nigeria.
Any disagreement, dispute or difference howsoever arising, from this Agreement, including its interpretation and validity or as to the rights, duties and liabilities of the Parties hereto or as to any other matter in any way connected with or arising out of or in relation to the subject matter of this Agreement, which cannot be amicably resolved by the Parties within 30 (thirty) days shall be referred to arbitration in accordance with and subject to the provisions of the Arbitration and Mediation Act, 2023 or any amendments thereof.
